Terms and Conditions for the Supply of Becka Ltd Products

By submitting an order, you are accepting the Terms and Conditions of the Becka Ltd web site.

Your details

a. When you register with the Becka Ltd web site, you will be required to choose a contact email address and password. You are responsible for all sessions and transactions taken under these details. You should keep your password safe and not disclose it to anyone. You should change it immediately if you feel it has been compromised.

b. If any of your details change, such as your credit card billing address, you must inform Becka Ltd as soon as possible. You may update your details by signing into your account on the Becka Ltd web site, and update the relevant section.

The Contract Between Us

a. Any contract for purchases made through the web site will be with Becka Ltd, 25, Elwell Avenue,Barwell, Leicester. LE9 8FH, United Kingdom.

b. Becka Ltd must receive payment of the whole of the price for the goods that you order before your order can be accepted, and the contract formed. Payment is not taken until the point of despatch of the goods to you from our premises in the United Kingdom. Once payment authorisation has been received, Becka Ltd will confirm that your order has been received by sending an email to you at the email address you provide in your registration form. The email will include your name, the order number and the total price. Becka Ltd´s acceptance of your order brings into existence a legally binding contract between us on these terms. Any term sought to be imposed by you in your order will not form part of the contract.

c. All images on this site are reproduced with a view to portraying our products as accurately as possible. Please be aware that designs may vary slightly, from those shown, due to normal design and production fluctuations.

The price of any product is in force at the date and time of your order. We may change the price of any product before you place an order. We try to ensure that out prices displayed on our website are accurate but the price on your order will need to be validated by us as part of the acceptance procedure. We will inform you if a products correct price is higher than that stated in your order and you may cancel the order and decide whether or not to order the product at the correct price.

d. The prices payable for goods are as set out in the web site, exclusive of any duties and local taxes.

e. Customers ordering for delivery outside of the UK will be responsible for payment of any local taxes payable including VAT, and will be required to pay extra for delivery and Customs clearance where necessary. See below.

Cooling Off Period

Under the Consumer Protection (Distance Selling) Regulations 2000, you have the right to cancel the contract for the purchase of your order within seven days of delivery (starting the day after the receipt of the goods).

To cancel this contract, you must e-mail us at jimpayne@becka.biz within seven working days of delivery of your order, quoting your order reference number, giving the reason for the return as ´Contract Cancellation´.

You should be aware that, once we begin the delivery process for your order, you will not be able to cancel the order should you decide that you do not want to receive the items.

You are responsible for returning the items and they must be received by us in a resaleable condition. The item must not have been used, must be complete with all components and the packaging must be not be damaged. Note that if these conditions are not met we may not accept returned goods.

We recommend Royal Mail Special Delivery for returning items.

Provided that the goods in question are returned by you and received by Becka Ltd in the condition they were in when delivered to you, we will refund the total amount of money paid by you for the goods, less any costs to collect and deliver the goods, within 30 days, starting with the day on which we receive a notice of cancellation from you.

Availability Of Goods You Order

If Becka Ltd has insufficient stock to deliver the goods ordered by you, we will notify you as soon as possible of the expected delivery date. Becka Ltd will not be obliged to offer any additional compensation for disappointment suffered.

PLEASE NOTE: We endeavour to bring our customers the best value we can by running special offers, but please remember stocks are limited at the special offer price, and subject to availability. We update our web site as quickly as we can to minimise disappointment. The process of updating the web site when goods have sold out at campaign price can take a few hours to update. Please note that the price the goods are offered for tender are as displayed in the Shopping Basket. Rest assured your credit card will only be debited as your order or individual items from your order are dispatched.

Delivery Of Goods To You

a. Becka Ltd will post, or arrange a courier on your behalf for, the goods ordered by you to the person and address you give Becka Ltd at the time you make your order. The consignee (i.e. the person to whom the consignment is sent) will be the declarant and importer into the country for which the consignment is destined. For non-UK destinations, the consignee will be responsible for both customs clearance and payment of customs duties and local taxes where required.

b. Delivery will be made as soon as possible after your order is accepted and in any event within 30 days of the order. All delivery times quoted on the web site are estimates only, based on availability, normal processing and delivery companies.

c. You will become the owner of the goods you have ordered when the goods are dispatched to you from our premises in the United Kingdom.

d. If you have not received your order within 10 working days of despatch, you must immediately advise Becka Ltd of the delay/loss. * In the event of a replacement order being sent, you will need to complete a ´declaration of non-delivery´ of the initial order. The declaration form will be sent to the email address supplied with the initial order and requires completion in full and return to the address supplied by Customer Services.

Should the completed non-delivery declaration form not be received within 10 working days of receipt, then you will become liable for the cost of the initial goods & postage, which will then be charged to the method of payment for your order. This charge will be refunded upon receipt of the completed non-delivery declaration form if received within 21 working days of the despatch of your replacement order. Duplicate forms can be requested from Becka Ltd Customer Services.

Customs charges

If you are ordering goods for delivery outside of the UK, please note that your consignment may be subject to import duties and taxes, which are levied once the goods reach the country of destination. Any such charges levied in relation to customs clearance must be borne by you. It is accepted by you that Becka Ltd has no control over additional charges in relation to customs clearance. Becka Ltd recommends that you check with your local customs officials or post office for more information regarding importation taxes / duties that may be applicable to your on-line order. You will be the importer of record and responsible for any import VAT and duty that may be borne. In addition, any charges for import clearance will be borne by you, the customer.

Please note that when shipping goods from the United Kingdom, cross border shipments may be subject to opening and inspection by customs authorities. In respect of all goods dispatched to you to an address outside of the United Kingdom, you are deemed to be the importer of the goods and must therefore comply with all the laws and regulations of the country into which the goods are being delivered.

Liability

a. If the goods Becka Ltd delivers are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, Becka Ltd shall have no liability to you unless you notify us of the problem in writing at the Becka Ltd contact address or by e-mailing: jimpayne@becka.biz, within 10 working days of the delivery of goods in question.

b. If you do not receive goods ordered by you within 30 days of the date on which you ordered them, Becka Ltd shall have no liability to you unless you notify Becka Ltd in writing at the Becka Ltd contact address of the problem within 40 days of the date on which you ordered the goods.

c. If you notify Becka Ltd of a problem under this condition, Becka Ltd´s only obligation will be, at its discretion i) to make good any shortage or non-delivery, ii) to replace or repair any goods that are damaged or defective, iii) or to refund to you the amount paid by you for the goods in question in whatever way Becka Ltd chooses.

d. Becka Ltd will not be liable to you for any indirect or consequential loss or damage arising out of any problem you notify to Becka Ltd under this condition and Becka Ltd shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under paragraph (c) above.

e. Nothing in this condition is, however, intended to limit any rights you might have as a consumer under applicable local law that may not be excluded nor in any way to exclude or limit Becka Ltd´s liability to you for any death or personal injury resulting from its negligence.

f. Becka Ltd do not represent or warrant the accuracy or reliability of any of the information, content including without limit text, audio, video, graphics, images and photographs, software or advertisements (referred to as the ´Information´) contained on, distributed through, streamed, linked, downloaded or accessed from any of the services contained on www.becka.biz

g. Intellectual Property
The Information and content by on or through www.becka.biz is for your personal, non- Commercial use only, save where expressly provided, and you agree not for yourself or through or by way of assistance to any third party distribute or commercially exploit all or any part of such Information or content.

All intellectual property rights, including without limitation copyright, in any Information or content provided to you by us on www.becka.biz, vests in Becka Ltd or its licensors. You may only make a copy of this content for your personal non-commercial use providing you keep all copyright and other proprietary notices untouched and you agree not to modify, reproduce, republish, upload, post, distribute or otherwise transmit or use the Information or content provided by us in any way without our prior written consent.

Force Majeure

Becka Ltd shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control.

Invalidity

If any part of these conditions is unenforceable (including any provision in which Becka Ltd excludes its liability to you) the enforceability of any other part of these conditions will not be affected.

Governing Law

The contract between us shall be governed by and interpreted in accordance with English law, and the English courts shall have jurisdiction to resolve any disputes between us.

Entire Agreement

These terms and conditions, together with the current Becka Ltd Web site prices, privacy policy, shipping and returns policy, and Becka Ltd contact details, set out the whole of our agreement relating to the supply of the goods to you by Becka Ltd. These terms and conditions cannot be varied except in writing and published on the ApolloEyewear.co.uk website. In particular nothing said by any sales person on behalf of Becka Ltd should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by Becka Ltd. Becka Ltd shall have no liability for any such representation being untrue or misleading.

Interpretation

In these terms and conditions:-

´Becka Ltd´ means the business of 25, Elwell Avenue,Barwell, Leicester. LE9 8FH, any connected organisation that actually supplies goods ordered by you and any successor to its business;

´working day´ means every day of a calendar year apart from weekends and statutory and public holidays;

´us´ means Becka Ltd and you together; and

´you´ and ´your´ means the person ordering goods under these terms and conditions.
